Fresh chargesheet filed against Ghandy

The new chargesheet filed against top Maoist leader Kobad Ghandy for his prosecution under the anti-terror law for being a member of banned CPI (Maoist) was on Monday sent to the sessions court for taking cognisance.
The chargesheet, along with a fresh sanction for Ghandy’s prosecution under the Unlawful Activities Prevention (UAP) Act, came up before Additional Sessions Judge Pawan Kumar Jain.
On his plea, the court gave Ghandy’s counsel time to compare fresh chargesheet with the previous one to see the new facts brought forth by the Delhi Police and adjourned the matter for next hearing on 25 May. The Special Cell of Delhi Police had filed a fresh charge sheet against Ghandy, accused of trying to set up a base of CPI (Maoist) in the national Capital, after ASJ Jain discharged him from the stringent provisions of the UAP Act for want of proper sanction.
While discharging Ghandy, the ASJ had said it was clear that Ghandy was an ‘active member’ of the CPI (Maoist) and it appeared that ‘his role was to persuade people and exhort them for Maoism’.
The court had also said that a prima facie case was made out against Ghandy for offences punishable under Section 20 and 38 (relating to membership of the banned outfit) of UAP Act. Following this, the Delhi Police filed a fresh chargesheet against the 65-year-old, before the chief metropolitan magistrate who accepted the same and directed that it be placed before the sessions court, which is empowered to try cases under UAP Act. Ghandy and his co-accused Rajender alias Arvind Joahi at present stand charged with the offences of impersonation, cheating, forgery and criminal conspiracy under the Indian Penal Code.
An alumni of the prestigious Doon School, Ghandy was said to be part of the top leadership of erstwhile CPI-ML (People’s War Group) from 1981 and continued as a Central Committee member in CPI (Maoist). He was elected to its Politburo in 2007.
