73 private schools asked to refund parents by Delhi HC

Seventy-three private unaided schools in the national capital have been asked to refund the extra fee charged between January 2006 and August 2008 with an additional 9 per cent interest. The schools had increased the fee for the aforementioned period in the name of Sixth Pay Commission requirements.

‘The Justice Anil Dev Singh Committee, formed by the Delhi High Court on 12 August, 2011, for the review of high school fees by implementing the Sixth Pay Commission pay has submitted its fourth interim report to a division bench headed by Justice BD Ahmed holding that as many as 73 private unaided schools have to refund fee to the parents along with 9 per cent interest thereupon,’ social jurist Ashok Agarwal said.

Agarwal said that the schools had hiked the fee taking undue advantage of the aforesaid order, while they had no requirement for additional funds. ‘The schools had sufficient funds at their disposal. The additional burden imposed by the implementation of the Sixth Pay Commission could have been absorbed with that. The 73 schools are cover all categories — A, B, C and D.’

The Singh Committee had put 173 schools under the scanner, of which, 73 were found to have charged fee in excess. The Directorate of Education has been asked to keep a tab on these schools and carry out further investigation. Records of eight schools were found to be unreliable and the committee has established a special investigation into the matter. However, around 55 schools have been given a clean chit in the investigation.

The 73 schools include Oxford Convent, Uttam Nagar; MDH International School, Janakpuri; Guru Nanak Public School, Rajouri Garden; Mirambika Free Progress School, Sri Aurobindo Marg; Rukmini Devi Public School, Pitampura; Kulachi Hansraj Model School, Ashok Vihar; New Era Public School, Maya Puri; Manav Sthali School, New Rajinder Nagar; NK Bagrodia Public School, Dwarka and Faith Academy, Prasad Nagar.

Senior government officials from the Education Department of Delhi on the condition of anonymity said, ‘Parents should write to the erring schools for the refund of fee and in case the fee is not refunded, parents should contact the Education Department for filing contempt petitions against the erring schools in the Delhi High Court.’
